1. Introduction
These Terms of Service ("Terms") govern your access to and use of the Your Group Trip mobile application, website, and related services (together, the "Service") provided by Your Group Trip ("we", "us", or "our").
By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. Eligibility
You must be at least 16 years old (or the minimum age required in your country to consent to data processing) to use the Service. By using the Service, you confirm that you meet this requirement.
3. Accounts
To use certain features, you may need to create an account. You agree to:
- Provide accurate and complete information;
- Keep your login credentials confidential;
- Be responsible for all activity that occurs under your account.
You may join a group via an invitation link without creating a full account, subject to the functionality we make available. Notify us immediately of any unauthorized use of your account.
4. The Service
Your Group Trip helps groups plan and organize trips, including features such as shared expense tracking, shared lists, group votes, and other collaborative tools.
Expense tracking is for informational purposes only.
The Service is not a bank, payment processor, or financial institution. We do not transfer, hold, or settle money between users. Any balances, settlements, or amounts shown are calculations to help you organize shared costs. You are solely responsible for making and verifying any actual payments between group members.
5. User Content
You retain ownership of the content you create or upload (such as expenses, lists, group names, and messages) ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, process, and display it solely to operate and provide the Service.
You are responsible for your User Content and confirm that you have the right to share it. You agree not to submit content that is unlawful, infringing, offensive, or that violates the rights of others.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful or fraudulent purpose;
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems;
- Reverse engineer, decompile, or attempt to extract source code, except as permitted by law;
- Use automated means to access the Service without our permission;
- Upload malware or engage in any activity that harms other users or the Service.
7. Subscriptions and In-App Purchases
The Service may offer optional paid features (for example, "Your Group Trip Pro").
- Purchases and subscriptions are processed by the Apple App Store or Google Play Store and are subject to their respective terms.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your App Store or Google Play account settings.
- Except where required by law, payments are non-refundable. Refund requests are handled by the applicable app store.
- Prices and features may change; we will provide notice where required.
8. Advertising
The Service may display advertising, including through third-party advertising networks. These third parties may collect and use data in accordance with their own privacy policies. Please refer to our Privacy Policy for more information.
9. Third-Party Services
The Service relies on third-party providers (for example, for hosting, authentication, analytics, purchases, and advertising). We are not responsible for the availability, content, or practices of third-party services.
10. Intellectual Property
The Service, including its design, software, logos, and trademarks (excluding User Content), is owned by us or our licensors and is protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use in accordance with these Terms.
11. Availability and Changes
We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice. We do not guarantee that the Service will be uninterrupted, error-free, or that data will always be preserved.
12. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that any calculations, balances, or information are accurate or complete.
13. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (such as liability for gross negligence, intent, or personal injury).
14. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of your use of the Service, your User Content, or your violation of these Terms, to the extent permitted by applicable law.
15. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, the provisions that by their nature should survive (including intellectual property, disclaimers, and limitation of liability) will remain in effect.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, within the app or on our website). Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
17. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, without regard to its conflict-of-law rules.
